Is it legal to swap my sim card to a new phone while my current phone is under contract?

I have my current phone still under contract for another year, but for Christmas my Dad bought me a new (and better) phone. I have to go to the company I have my contract with to get a different sized sim card to fit the new phone, but I'm going to keep my old phone as a spare so I won't be selling it. Will the phone company give me another sim card to use in my new phone, or will they make me wait until my contract ends?

it doesn't matter what phone you use as long as it's compatible with your phone company........................... your contract just says that you must remain a customer with that company for x number of years...........................

if the new phone is either on the same network or is unlocked, you can move the sim card to it........................... your provider doesn't care what you do with either phone - all they care about is that you pay your monthly bill...........................
